General Terms and Conditions of Pro Subkultur (PS-METAL)
1. scope of application
These General Terms and Conditions (GTC) apply to all orders placed via the webshop at www.ps-metal.de. Contractual partner for all orders is Pro Subkultur. The current version of the GTC at the time of the order is valid. Deliveries are only possible within Germany. The contract is concluded exclusively in German language. For deliveries to other countries please contact us.
2. conclusion of contract
The display of articles in the webshop is not a binding contract offer by Pro Subkultur, but only an invitation to you to place orders. You can only order articles in household quantities or in the maximum quantity indicated on the respective product detail page. When you click on the "Buy" button, you place a binding order for the items in your shopping cart. Immediately after receipt of your order, we will send you an order confirmation by e-mail. This does not constitute a purchase contract. A contract is only concluded when we expressly accept your order or carry out the delivery, and to the appropriate extent. We store your contract text (the content of your order). Until the complete payment of the purchase price the goods remain property of Pro Subkultur.
3. prices and shipping costs
The prices stated in the webshop at the time of the order are valid. The mentioned prices include the legal value added tax. In addition, there are shipping costs as well as separate fees, if applicable.
4. terms of payment
We reserve the right not to provide individual payment methods for individual orders. If costs for the money transaction are incurred, these are to be borne by you.
When paying cash on delivery, you pay only when the order is delivered by the post office. The costs for cash on delivery can be found in the price table.
If you pay by bank transfer in advance, you will receive a payment request from us. Please transfer the amount to be paid within 7 days (payment deadline) to the specified account. Only after receipt of your transfer we will deliver the goods. If the amount is not transferred within the payment period, we can not reserve the goods for you.

6. liability and warranty
Pro Subkultur is liable without limitation for intent or gross negligence of Pro Subkultur, its legal representatives or agents. Pro Subkultur is liable for the slightly negligent breach of essential contractual obligations (cardinal obligations) to the contract-typical, foreseeable damage. Material contractual obligations are those whose violation endangers the achievement of the purpose of the contract or whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner may regularly rely. Pro Subkultur shall not be liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
The above limitations of liability do not apply in case of injury to life, body and health, for a defect after assumption of a guarantee for the quality of the product and in case of fraudulently concealed defects. The liability according to the product liability law remains unaffected.
As far as the liability of Pro Subkultur is excluded or limited, this also applies to the personal liability of representatives and agents of Pro Subkultur. Of course you are entitled to the legal warranty rights.
7. protection of minors
A delivery of products that are subject to an age restriction or have not yet received an age release, we send exclusively with the age and identity check of the German Post. An age and identity check can only be carried out in Germany. For this you have to enter your date of birth when ordering. The costs for the age and identity check can be found in the price table. The fee is charged only once per order, even if you order multiple age-restricted items. This also applies if these items are delivered in multiple shipments. When delivering the goods, the letter carrier will check whether you are over 18 years of age and whether you are actually the person placing the order. For this purpose, he will compare the information in your order with the name and address in your identity card or passport.
8. ordering tickets
8.1 Tickets and vouchers for services of other providers
If tickets for events are offered in the webshop, we are not the organizer. Ordered tickets are excluded from the right of cancellation! We can cancel the ticket purchase if you violate event conditions or try to circumvent them. The declaration of cancellation/withdrawal can also be made by crediting the amounts paid.

10. final provisions
These terms and conditions as well as all sales contracts concluded in accordance with these terms and conditions shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you as a private end user do not have a domicile within the European Union, our place of business shall be the place of jurisdiction.
